Hacienda Encantada failed to purchase the timeshares that we traded in to them.

We purchased at Hacienda Encantada, Cabo because they said we could trade in our units from Villa de Arco, Cabo. They have not followed through with getting us out of Villa de Arco and we have had to pay 2 maintenance fees as we argue with their slow process. Can we cancel our contract with Hacienda Encantada based on the fact that they did not adhere to their responsibility of the contract? Can anybody help us with advice or experience in this situation ?

If you are still within your 5-day rescission period, you can rescind regardless of what the sales people told you. Unfortunately, you cannot rescind based on lies if you have passed your rescission period.

Sadly, we hear of this situation often here on TUG how the sales people promise verbally to "trade-in" the buyer's current timeshare but then don't follow through and leave the buyer with two timeshares.

A few in S and VA, a single resort in NC, MD, PA, and UT, plus Jamaica and the Bahamas
Typically the agreement to buy or sell your unit is with a third party so unless the specific contract for you to purchase the timeshare guarantees the completion of the sale of your unit the two agreements are separate.

When I purchased at Hacienda Encantada, they promised to take my Pono Kai (Kauai) and Pueblo Bonito Sunset as trade-ins in reducing the sale price.After I got to the US, I was contacted and told I owed them $3,000 in fees for the "trade-ins." After weeks of aruments, they agreed to take $1,700 and I would keep Pono Kai and Sunset.

Last June I attended a resale presentation by K&M Liquidation of Houston, Tx. I gave them $4300 to take both timeshares. They then sold to their "partner" Kirk Marketing & Consultaion of Knoxville, TN (Title Co.). Nine months later, nothing hashappened as there are no "interested parties." I am out $4300 and still own the timeshares and will have to pay maintenance fees again in December. I am wondering if it is time to consult a lawyer. If I still own the timeshares, I want my money back. Also, the original company K&M refuses to return my phone calls and texts. I guess they think they're out of the deal now that they gave to Kirk. Anyone else gone through this?

Sounds like a scam. Not many tuggers have gone through your situation because we don’t recommend using upfront exit companies.

If your contracts are paid maybe just walking away is the thing to do. Both the Arco and Hacienda are Mexican corporations that would have many problems if the pursued the matter.

Vidanta at Mayan Rivera gave me credit for my HGVC timeshare toward my Vidanta timeshare. I was told that HGVC would buy it back. I asked why would they pay so much for mine when they could buy it on eBay for almost nothing. The answer was that they do not like to buy on those 3rd party markets. I was given a contract with Timeshare Resale Marketing (TRM) thereafter, they were to handle the transaction to HGVC; I was told upfront there is a $1000 fee for there work. I was OK with that if I could get rid of the HGVC timeshare. But a week later I come to realize that TRM was not handling the guaranteed sale to Hilton. TRM was just advertising my timeshare on their website for what I owed on it, which was ridiculous you know...because you can buy it on eBay for nothing. However, they have a guarantee that you get your money back if they do not sell it. You have to call them within the year (not after 1 year). It is coming up on a year it has not sold! I will update this post to let you know what happens.

Good luck with any refund. Keep up posted, but I suspect that it simply won't happen.

There are so many warnings on TUG about the "trade in" of a Timeshare to buy a different timeshare in Mexico and about the upfront fee companies that say they will sale your timeshare.

I would be surprised if they sell it, and even if they do sell it I would be surprised if you ever see a nickel.
