Today (Saturday 11/9) I signed a contract in Las Vegas and after reviewing everything, I plan to rescind. I found the cancellation paper in my packet and it states “the purchaser of a time share may cancel, by written notice, the contract of sale until midnight of the fifth calendar day following the date of execution of the contract”. It also says “the notice of cancellation may be delivered personally to the developer, sent by certified mail, with receipt requested, or sent by express, priority, or recognized overnight delivery service, with proof of service, to the business address of the developer”

There is a place for me to list my contract number, sign, and the address is listed in Orlando, FL.

Do I need to send anything other than this form? I see that others wrote a letter and some mailed back all of the paperwork.

With tomorrow being Sunday and the holiday on Monday, I plan to be at the post office on Tuesday. Do I need to send it overnight so that I arrives by the fifth day (Thursday) or does it only matter that I mail it by Thursday?

Thank you in advance. I knew I should have never agreed to the presentation, but it was definitely a moment of weakness and I should have done more research. It’s only been 8 hours since I signed, and knowing that I plan to cancel has eased my mind.

Spend the You don't need to, but it is the most reliable way.

Anyone that signed the contract should also sign the rescission letter. The form they gave you probably has all names that signed.

No need to do this unless the instructions in contract say so.

All persons that agreed to sign the contract must be in agreement to cancel the contract meaning all persons that signed must sign their consent to rescind. The legal term is called mutual consent.

Thank you for the replies. I signed the original paperwork by myself, so I signed the paper this morning and mailed it this afternoon. I sent it certified mail with return receipt. It’s scheduled to arrive on Monday 11/18 but I have proof it was mailed today 11/12.

You did well.....

Now, sit back and relax. Allow up to 45 days for a refund (may be sooner).
