First time timeshare purchase issues-please help!

Please read below, I know that it is long but it explains timeline and the issues that I am having. I don't know how to proceed or what I should do at this time, if any of you have any suggestion please let me know....Thanks!

I saw an ad for the San Luis Bay Inn being sold by the Mid-west transfer here on TUG and proceeded with the purchase on July 14th, I provided all the necessary information and received a receipt on that day.

On September 6th I received a letter from San Luis Obispo County dated September 2nd stating that the legal description did not match the acquisition document as the interval number was not listed, as such transfer of ownership did not occur, the warranty deed was dated August 7th. This document shows that the previous owners and the Midwest transfer were carbon copied on the documents. On September 7th I sent this information to Midwest Transfer. I received an email the next day stating that it has been given to the title department and they will get it resolved as soon as possible.

On September 21st I received an email from Midwest Transfer with an attachment stating that it was the recorded deed and that it was sent to the resort for final approval, but this document had the same date of August 7th which still had the same incomplete information. On October 9th I called San Luis Obispo County and they confirmed that the property had not yet been transferred to my name. I emailed this information to the Midwest transfer and they stated they would call the county to get help.

On October 30th I emailed the mid-west transfer once again and asked for the status and let tem know that within 1-2 weeks I would be looking at what my options are, they replied and apologized for the delays blaming the issue on the fact that the county is not online and therefore has to be mailed in to record and upon its return they would let me know when it was recorded.

I have not heard anything further from the Mid-West transfer.

On November 5th I received a letter from Diamond resorts dated October 30th stating that my transfer has been completed and I am now an active owner. I immediately called Wyndham who manages the San Luis Bay Inn to reserve my room for 2016 when they stated that I was not in their system, they asked for the name of the previous owners and it still shows them in the system. I tried calling diamond resorts Title & recording department numerous times and it would always eventually go to voicemail. That evening I sent them an email stating the issue and asking what needed to happen for the transfer to be truly complete so that I could book a room. On November 12th I finally received a reply email stating that they were sorry but could not answer the question but if I had any more questions call 877-DRI-CLUB, I immediately called 877-DRI-CLUB and after waiting I was transferred to Owner Services for Wyndham, who said they were sorry but could not help me as it was Diamond’s responsibility to provide the transfer of ownership information. On Friday November 13th I called Diamond Title & Recording department once again and was initially told by the person whom answered that she would have to defer to the person who sent me the letter stating that transfer was complete who was the same person that stated that they could not answer my question via email. I practically begged and asked for her help and she stated that she would look into and would get back to me by Friday at 5:00 pm but I never received a call back.

Does anybody have any advice or have contacts that can assist, so far my first timeshare purchase experience has been awful!

What independent research did you do on this purchase?

For instance, did you get an estoppel letter?

How much did you pay for it? What payment method did you use?

I read quite a bit on tug before pulling the trigger, I looked up the mid-west transfer, LLC online and did not find anything negative about them. I did ask for and received an estoppel letter, it is a fixed week(week 18) annual 1 bedroom unit, it was $500 which stated it included closing and transfer fees. I paid with a credit card.

Did you call Mid-West Transfer about this problem? There could be someone at the resort in particular that they dealt with that you can call? San Luis Bay Inn?

I know nothing about Diamond resorts, but I know when I got my week I was in constant contact with the transfer company, the company that handles sales for the resort, and the company that operates behind the scenes for things like billing, etc. It was the behind the scenes management company that I was finally able to verify being in system.

Was the estoppel letter prepared by the resort management company on their form or letterhead, or by the seller or closing company?

Does the info. on the estoppel match the info. on the deed?

Have you called your credit card to see if you can still dispute the payment? I would do that immediately.

It will definitely get the seller's attention and give you some leverage.

These two events conflict:

Something does not add up here, and this is why:

Before Diamond resorts could transfer the deed to you, they would have to receive a copy of the new deed, with the counties stamp on it - indicating that it had been officially recorded with the county.

How could Diamond have received a recorded deed, if it was rejected by the county?

The estoppel letter is from Diamond Resorts and the information matches as far as unit type and week..See attached for the estoppel. I have not called the credit card company yet as I wanted to get feedback from the forum to make sure that I was not being too impatient with the process but I will call them tomorrow. See attached for a copy of the estoppel

The Mid west transfer said it was going to send the documents to the resort for final approval, when you look at the warranty deed you probably can't tell that transfer is not complete, but the cover letter clearly states that they were not making changes to the ownership records. See attached for letter from county.

No I have not yet contacted the mid west transfer about the issue with not being in Wyndham's system(they manage the San Luis Bay Inn which is Diamond affiliated)since they have been unable to show that the deed was in my name yet, I was surprised to see the letter from Diamond saying that transfer was complete when as far as I can tell the transfer of ownership has not yet happened. I did call the San Luis bay Inn front desk and they had me call Wyndham owner services but like I stated I am not in their system so they could not help me.

I would call Mid-West transfer and explain this whole thing. They might have a bit more insight as to what could be happening. Also, there has to be someone at Diamond Resorts that they have been working with on the transfer and if you can get THAT person's name from and phone number from Mid-West maybe you can then speak with him/her at Diamond directly.

The only experience I have had was with my Pollard Brook purchase. I kept in constant contact on the phone and via email with the person at the transfer company. I also kept in constant contact via phone and email with the person at the sales company (Innseason) handling the transfer and then at the actual transfer phase I had to do quite a bit of digging to get the right phone number and person to talk to at VRI, the mgmt company to make sure I was in their system. I went right to the corporate level/person with emails and phone calls.

Time to get a bit nasty and demanding...
