Father (w/Dementia) listed his TS with a "Marketing Agency" for LARGE FEE

Please Help! I am a daughter of an 80yo father with Dementia &/or other Memory Related Illness.....Is there anyway possible to get out of a "Subscription" (which they call it) with a Marketing Agency??? I believe he needs to sell this TS however I believe he went about it all wrong! He tends to jump into things as last winter he changed his Power Company just because someone came door-to-door! I worked diligently to get that reversed and now this winter I am contending with this. Any and all hints/advice would be greatly appreciated! I feel blessed to have found this TUG site this morning!

If he has be legally deemed incompetent then he had no legal right to contract. You can dispute charges and get all your money back.

Have you tried calling the people he listed with, threaten them with a complaint to their state attorney general, and so forth?

If your father is willing to appoint you as conservator/guardian of his person and his property, you'll have the legal authority to prevent/block those sorts of thing in the future. You can get the paperwork from your local probate court. It should be a do-it-yourself project, except you may have to hire a lawyer to represent him (not you) at the hearing--so the court will be satisfied that you're not taking advantage of him.

I hope Im wrong but

id bet that money is gone and Im pretty sure an attorney to fight it will just be more money down the drain

One of the attorneys that frequent these boards my be able to give you better advice.

at the very least Id post it here on TUG as a give away..

-Approach your father in a non confrontational way, and see if he will allow you to take take over management of his finances.

-If he refuses, contact Adult Protective Services and ask them to do an evaluation. If Adult Protective Services finds that he is incapable of managing it himself, even if he isn't willing, you can get a court order.

We had this trouble with my mother, her trigger was magazines, she sent a check to a magazine subscription and wrote NO MORE MAGAZINES! In the memo! Dementia is a very cruel disease. I dispise the folks who take advantage of the elderly. Hopefully you can take control of your father's finances, but if he is anything like my mother, you are in for a fight with him! Good Luck!

Excellent Advice from all who replied!!! Thank you, Thank you, Thank you! I was successful at getting the $998 refunded to my father with just a small bit of hassle. (Father still believes he was paying his Maintenance fees and NOT paying for a Subscription with SMTN Marketing agency BUT......)

At any rate, now moving forward....what needs to be done to get this Wyndham Seawatch sold??? I have spoken to them directly and since they do not offer a Buyback program they have suggested that we "Deed it Back to them".....Would this be Beneficial or what are your Opinions on this? I would rather my Father get something (if even a small amount) for his TS as he just paid his 2016 Maintenance fees of $920 last week.

that is outstanding! so very happy you were able to get the upfront fee refunded!

IMO there is a special place in hell for those that exploit the elderly.

You could list here in the Marketplace for free (if you have already paid a $15 membership). You could either list it with free 2016 use or at a lower cost and expect reimbursement of the annual fees. You may want to go ahead and reserve a week now so the new owner does not get shut out this year.
