Don't know what I should do about Tahiti Village purchase

I purchase a biennial odd year Tahiti Village Moorea unit for $340 back in March 2015. The seller was supposed to pay all closing cost and maintenance fees for 2015 and 2016. Now in order for the sale to be complete Global Resorts Transfer informs me that I need to pay the first half of the maintenance fees for 2017 - $201.50. Granted the sales listing stated the fees were $201.50 per year. I would like advice on whether I should continue with the purchase or request a refund for the amount paid.

It would seem that the seller fulfilled all of their obligations and paid 2015 and 2016, so I'm not sure what you would base a request for a refund on. The resort is asking for payment for 2017, which you had already agreed to pay when you purchased the unit.

It's possible that the resort management will not transfer ownership to you, without the MF being paid in advance - this is becoming common.

However, I would write a check to resort management and send it to the closing company - not to the closing company, to be sure it is indeed applied to your maintenance fee.

It's probably not a bad deal, as you'll use or exchange your 2017 week anyway, and cheap 'insurance' for the HOA and other owners to keep from 'accidentally' transferring ownership into a Viking Ship thing that eventually causes the other owners big $$$. Viking ships don't pay MFs upfront in advance.

Yes, this is exactly what it is. I purchased my first timeshare at TV (way before I found TUG, so I overpaid by 13K). After I found TUG, I purchased another week at TV for exchanging in II - it was only $1 and maintenance is less than $400 a year. When we closed on this $1 deal, the resort asked for maintenance fee in advance before transferring.

Great resort.

Wait a minute, this is an EOYO, so the first half of 2017 is paid in 2016. So the listing seems a little misleading to me. Seller did not pay the "2016 fees". There are no fees for the 2016 use year as there is no use, but it's worded so that a reasonable person would expect to pay no fees in 2016, which is now being asked of you before it can transfer--the 2016 fees payment which is the "first half" of the 2017 use year.

Actually, Maintenance fees are due every year even for EOY memberships. The EOY fee is half the every year fee.

TV will not transfer a unit without the maintenance fees being paid in advance. You should be able to arrange to pay the resort directly. And the amount you pay will show up as a credit on your TV owners account once you close. You won't owe any fees until 2018.

That is exactly my point. By stating that 2016 MF were paid, the listing inferred that no MF would be due in 2016. Now, in fact, TV wants the 2016 payable settled in 2015 before transfer.

Thank you for all your responses. When I called the resort to pay the fees, I was informed I actually had a credit balance, so I didn't have to pay any additional fees besides the purchase price.
