Do timeshare owners have the right to see a management contract

Our BOD recently entered into a management contract with an unfamiliar company. The board members signed NDAs with the company and the timeshare owners have not been provided with a copy of the contract. Do we have a right to see the contract?

Short answer is no, unless your CCRs specifically say otherwise (which I doubt).

A random owner can request to see it, but the board is not compelled to produce the agreement (barring some other force in play such as a court order).

Though I think it is fair to inquire why the board signed an NDA with the management company covering sharing of contract terms.

Many states have laws that owners have rights to see record including contracts. Check the association law and records request laws. They don’t have to make it easy for you to see it but the state law should outline the process. For example in FL you have to send a certified letter requesting the records then they have a period to reply giving you a date and time to view the records.

Also, you are right to suspect any board of directors that intentionally hides contract terms from owners.

I would think that their costs would need to be disclosed in the financial statements. Keep a sharp eye on the reserves.
