I highly doubt it would be removed. The state currently sends a portion of the TAT to the counties. HB862 removed that "rebate" to the counties and allows the counties to implement a 3% TAT on their own. Some counties have complained that the 3% will be less than they have previously received from the state.
That would probably be deemed unconstitutional.
U.S. Const. Art. IV § 2. The Privilege and Immunities Clause generally prohibits a state from imposing higher tax rates or taxes on nonresidents than it imposes on residents.
Maui County
The timeshare tax rate for 2021 is $14.60. The hotel tax rate for 2021 is $11.75. Therefore the timeshare tax rate is 24% higher than the hotel tax rate.
However the Maui timeshare tax rate is 82.5% higher than a non-owner occupied residence valued at $1.5+ million.
Since Maui County settled/lost the timeshare tax case the rates of other property has increased at a much higher rate than that of timeshares.
Couldn't disagree more with this. While we generally always stay more than 10 days, I don't want somebody setting some arbitrary limit on how long I can and cannot stay.

People who purchased homes with the specific intention of using to rent have removed those places from the grasp of Islanders who are looking to own a home.
The 3% is only an addition to the 10.25% you are currently paying with each night's stay. Hawaii has been charging this tax for as long as I've owned and we purchased WKORVN pre-construction.
I'm not sure which hotel you are referencing but if you stayed at WKORV, WKORVN or Nanea you paid it whether you recall it or not. You should be able to reference the Westin timeshare folio which is emailed to you after each stay if you provided an email address.
