Advice needed - Trouble with using my owned deeded week Bluegreen Oasis Lakes Fountai

Why should he have had to reserve his Week? He owns it. At one time I owned Fixed Unit/Fixed Weeks at 6 different HOA Controlled Resorts. Never once did I have to "reserve" anything. Sometimes I would call the Front Desk of the Resort to make sure that my Unit was in my name but I never had to "reserve" anything. I just showed up and used my Week. It was never a problem.

That is the crux of the matter: The owner believes he owns a fixed week - but the resort records show that it is a fixed/float week. A fixed/float week has to be reserved.

If you read post #17 you will see that I too own a fixed week, fixed unit (two of them actually), on paper, but the resort rules make this a floating week.

We really don't know at this time exactly what his ownership entitles him to. It would be nice if someone at BG would explain why he can't just show up instead of just telling him he can't.

I have owned other fixed week and fixed units and never had to make a ressie but every resort and resort system is different.

It may be that the OP does not have to make a ressie but the way his ownership is listed on their records, at the present time he can't have it.

I really hope he gets it straightened out, but for this year, I think it's a may be too late.

First of all just because the old owner says it is a fixed week does not make it a fixed week. Many people come to this website thinking they own a fixed week because the deed says so BUT they own a floating week. In many TS systems, the week (and unit # ) on the deed are not an indication that you own that week but an accounting tool used so the TS can not sell more weeks than are owned at the resort.

I doubt you can get an answer to this question from the resort but will need to get an answer from the TS system.

IMHO it is foolish to go there demanding a room. Book a room somewhere in Orlando then if you are right in the end, you can demand reimbursement.

A few in S and VA, a single resort in NC, MD, PA, and UT, plus Jamaica and the Bahamas
Knowing Bluegreen doesn't help. The Oasis at the Fountains like many other resorts in the system was built by another developer. Bluegreen took over in 2003. They started selling units in the buildings they built under a different RCI ID called the Fountains. I know there are floating/flex weeks (1-52) at the Oasis at the Fountains (buildings 2 and 3). There may also be fixed week owners. Pre Bluegreen resorts (now managed by and in the Bluegreen system) run the gambit of types of units and reservation rules (UDI, blended UDI, fixed, float, points, etc)

He needs his specific HOA rules. Perhaps it indicates specific unit numbers as fixed while others float or perhaps it indicates they all float.

This sticks out that to me that your fixed week predates Bluegreen and rep said they don't sell your kind of ownership any longer. Translates seemingly that Bluegreen rules don't matter on your week and possibly their computer system somehow got confused and included it. Add to that your previous years you deposited into an exchange system they deposited week 51 seems to add to this possibility. Good Luck.

oh wow, so the saga continues...

I never did ask for the owner packet - never had one sent to me - and there is nothing on bluegreen online where I can download it.

So I called, got a friendly rep this time. I asked if they could send me the owners packet and terms and conditions (like reservation policy, etc)

He said they don't have it. He said that my purchase of the week at Oasis Lakes predates Bluegreen and they don't sell my kind of ownership anymore.

I asked again what I should do, and he asked me to take fax (again) all my documents and he said the finance team would take a look.

Back to square one - I think this is a legal problem. I wanted to avoid this and simply spend time with the wife/daughters before going back to the middle east. It's very unfair.

Thank you all very much. Apologies if I made some people upset with my questions - but I am so disappointed

Update on my situation

Hello

I have an update to share

I did show at the resort with my family for the week I owned. We live a few hours away elsewhere in Florida, so we were prepared either way for whatever outcome.

I did present myself at the Oasis Lakes Resort on 19 December 2015
deed in hand and resort confirmation showing it was a fixed week.

The manager at Oasis Lakes was really nice. Refreshing change - the staff at the resort are far easier to work with then Bluegreen Vacation Owner services.

After some discussion, they DID let me and my family check in, and I
am currently writing this from my villa.

We're very happy to be in a villa but the experience getting here
hasn't been satisfactory. We couldn't fully enjoy our ownership with
all the problems associated with making a reservation.

There are a few contested issues still unresolved that we are hoping will eventually be resolved between myself, my attorney, and BG.

1) While they let me check in, they said that I had to give them 6
months notice - make reservations six months in advance. This seems
the standard protocol for a 'flex' week and not a fixed week which is
what I own and have documentation to prove this. (I am of the opinion
that think I shouldn't have to make a reservation at all). I'd like to get
a confirmation from Bluegreen once and for all that I own a Fixed week
and not a flex week as they have been claiming since my first attempt
to make a reservation / confirm ownership usage. From what I have
discovered, Bluegreen doesn't sell flex/fixed week and this ownership
predates bluegreen's ownership of the Oasis Lakes Resort.

I am asking that I receive a written confirmation that I own a fixed week during week #51 and Bluegreen will permanently allow me to use my week and my villa indefinitely.

2) When I contacted my attorney, they did something to my profile. My mailing address and email was changed to the address of the law firm. I can no longer update my profile. This was done without my permission nor consent.


3) While I was here, they asked me to attend an owners update with
the promise of $75 dollar Visa gift card. I agreed and went to the
appointment (I need to know about my ownership apparently ) - about 25 minutes into the meeting, the manager stopped the representative and said he couldn't continue as my attorney had to be present. They then refused to
honor giving me the 75 dollar gift card for my participation. That
wasted my time - and I am upset. I asked the manager to not solicit
to me any further owners updates or sales presentations as they didn't
honor their agreement (all because I have an attorney trying to help
me out
- crazy).

4) There are no terms and conditions of my ownership anywhere on the
Bluegreen website. (last post is spot on about predated ownership) I called Bluegreen Vacation Owners Services to get
a copy and they could not provide them saying my ownership predates
Bluegreen's ownership at Oasis Lakes Resort. I believe the original
terms and conditions from the original ownership (not whatever
Bluegreen comes up with) should apply. Nobody
has been able to help me get my terms and conditions upon request.

I would like a copy of the original terms and conditions at sale. Bluegreen shouldn't be able to change the terms and conditions at will or be capricious.

Glad we are here and Oasis Lakes is a beautiful resort, but why all the fiasco? Why put me and my family through all this? If I was able to speak with a supervisor when I called vacation
owner service (I called FOUR times) , if the representatives were
more professional, provided their FULL name, got back to me when they
said they would get back with me, I wouldn't have needed to seek help from
my attorney. I am a disabled veteran who works overseas and sees my
family very little. I don't deserve to be treated like this. I hope that BG will eventually make this right.

Anyway - I really like this forum and glad to be a member. Some of you provided some really good advice and I think a few ideas or some effrot behind the scenes allowed us to check in. I do appreciate everyones input in this lengthly thread.

Bluegreen - please remember - I am an OWNER at Oasis Lakes and not a guest!

Could be BocaMike, I have a problem with just two things -

First - as another poster indicated, as I am owning a fixed week, why is a reservation even necessary to begin with? So I can set my calendar reminder to coincide with my maintenance fee payment at the beginning of the year - to reserve the week I already own - whether I choose to use it or not. If I don't want to use it, I believe this is MY business; I own the week and paid the maintenance fees - why should BG get to use and profit from MY villa without my consent?

Next - suppose you are right - and you could be right , at least from BG's perspective - then where are the terms and conditions (T&Cs) ? They are not posted anywhere on the BG website (in my owner account back office). I called and asked them to send to me and the representative said he couldn't provide as my ownership predates BG's management. I would disagree BG can just make up T&Cs for my ownership as they want to - but I should be governed under the original ownership T&Cs when the purchase was made.

When I called the BG vacation owners services, I have received conflicting information and poor customer service. It would have been so much easier and pleasant to have gotten a correct answer first time asked, to be able to speak with a supervisor when requested, to be given the FULL name of the representative I was speaking with over the phone (oddly, they said they couldn't do that, but everyone at the Oasis Resort had a name tag there with their FULL name - :mad: ). Does that seem fair to you , BocaMike et al ?

Anyway - I am behind all this now. I was able to check in last week and use my week. Yes, I will dutifully call and reserve the week I own this week for 2016 (after I speak with an executive from BG who has promised to get back with me 4 January). I will probably sell the timeshare (for a profit - not give it away - as it has value - others not affiliated with BG but believed to be in the know privately told me BG would take back the week if I didn't want it - ah, no, I'm not just going to give it away - they don't make these fixed weeks anymore!) At least I can try to sort out the terms of my ownership for a potential buyer. The resort itself is very very nice - too bad Bluegreen's management is just plan awful. I will keep if can't sell for a fair price.

I just had an offer accepted with DVC; much more excited about this ownership and staying at Disney.

Asking out of ignorance... Wouldn't the original mortgage have to be registered with the local Property Appraisal office? Would it contain any information that might be relevant to this issue?

Have often wondered if you could identify owners by doing search of property owners at a particular Resort.

There isn't going to be info on fixed or flex weeks on the vacation club website because Bluegreen is not in the business of selling fixed or flex weeks, they sell points ownerships.

I'd go back to Resort Title and ask them to vet the history of that unit week. A mistake was made somewhere, and I wouldn't rely on reseller info as to sorting your beliefs. I have a fractional that shows one unit week as my ownership but that is not accurate, so understand that sometimes system entries cannot accurately reflect the true ownership.

Glad it worked out in getting to stay there, but sorry for your getting so worked up about it, and the sales spiel knock out factor due to representation. Seems your lawyer is now your timeshare legal guardian. The presentation would not have illuminated anything for you since it would have been about BG Vacation Club points, which is not what you own.

Just because someone bought a certain ownership in the past doesn't mean the rules in effect then are in effect now. Finding out if and how they changed will help immensely.

I think there is no point in finding original owner. You would still have to vet whatever they say as surely you know that some people have no idea what they own.

When you locate your correct HOA you will be able to get T&C, but understand that this HOA predates BG's ownership of the property and most BG employees aren't going to be well versed in what was vs what is in non vacation club ownerships. Do you receive invites to annual meeting for this property? I'd start with any regular mailings you get to try to ID HOA folks that can help untangle this. But previous owner is not likely to be of any use to you.

Yeppers, things change. Could have happened at time of transfer, like the end of fixed weeks at that resort. I am not a real estate lawyer so from where I sit, anything could have happened, including conversion to flex week even without it specifically spelled out in your contract as the updated bylaws may not have been provided to you.
