2012 Maintenance Fee Payments

Hi,

I am in the process of trying to close on taking over a week at a Wyndham resort. I am a little irritated, because the closing attorney took over six weeks to contact me, and then gave me a bogus line about "leaving messages and sending e-mails". Since I've had no missed messages from him and no missed e-mails, I know he's just trying to cover his tail. Because of this, I'm leary of the answers I receive from him. So I thought I would ask here.

If I send him back the paperwork tomorrow, and he files everything in VA when received, I'm figuring that the earliest he will file will be December 5th. If he is then able to mail the paperwork at the same time (assuming he doesn't have to wait for the local county to do something to file), Wyndham should receive it by let's say December 9th. From what I understand, it will take them another 8-12 weeks for them to acknowledge the change of ownership. Is this right?

If so, this is where I think I have a problem: Would this mean that the 2012 dues would be due in full, along with a late fee, because they were not paid by January 1st, and that I would begin to pay monthly maintenance fees for 2013 at the same time and need to make up 2-3 months payments there as well?

The attorney is stating that as long as he files by next week, I won't be subject to any extra fees, but I'm the suspicious type, and I know that he's not working for me or my best interests. Since you are the people with the most expertise in these situations, I thought I'd find out where I stand here.

have you tried contacting wyndham and see what they say.. if you are not sure about the attorney go to the horse.. as it were.

I thought about going to Wyndham, but remember... I'm suspicious, and I read TUG... I was afraid that they'll tell me anything to get me to buy direct instead of resale. They'll convince me that I need some $45,000.00 add on Diamond Platinum Titanium VIP VIP package (with free parking!).

I felt safer posting here.

I also didn't know how much Wyndham would tell me, as I am not an owner yet.

Almost all of the folks at both Wyndham corporate and at the resorts have always been helpful to me (the one exception is the sales department which should generally be avoided)......My perception is that all owners are treated the same (retail and resale)

so call he correct department at wyndham (probably the Wyndham Financial Services Department 1-888-739-4022) - and see if they can help

I'm paying monthly and not in advance. It's the 2011 fees that must be current in order to close a sale now. If it goes into January, wouldn't you owe 2012 by the month as the year progresses? I might be wrong, but the 2013 budget has not been approved yet; so how do they know what to charge for that? I might be wrong, but what you are saying is not clear to me.

First. If you are not yet the owner, then you do not owe maintenance fees. They are billed to the current owner until the transfer is made.
Second. Depending on whether you have Points or Fixed week Contract will determine when the MF are due. Fixed weeks contracts are due October 31, 2011 for 2012. Points are billed in MOST cases monthly, so the present owner would have to pay the MF fees in advance or provide a way that they can be paid while the transfer process takes place. If something is not right, Wyndham can/will stop the proceedings until everything is brought up to current status.
So it depends on what kind of property(Fixed weeks or Points) you are buying and what kind of provisions have been made between you and the seller as to whether you can close sucussfully. I know this still does not answer all of your questions, but I hope it helps clear up something.
