When do the rescind period starts

Hi,

I might found this website too late and kicking myself. We are already a BG owner and on Sept 14th 2019, we brought more Bluegreen (BG) points and signed a new contract. Part of the new contact is the administration processing fee is supposed to be financed with the purchase. In other words, we don't have to pay anything at the signing. BG called us about a week later saying they could not financed the fee with the purchase. They said we can pay the fee with credit card, and we did. They mailed us new documents to sign and we received them on Sept 23rd. The odd thing about the new documents is it still dated Sept 14th 2019. We signed and mailed it back that day because they said they need it right away. I have a 10 day cancellation period and according to contract, the 10 day starts when we sign the contract or the date on which we received the last of all documents required. Do my rescind period starts on Sept 23rd or Sept 14th? Thanks in advance.

Day 1 of the rescission period is the day after you sign the contract. I think you are anew owner. But then I'm not the business office of BG. If you feel you have a valid argument for being within the allowable rescission time frame, you would only be out the cost of postage to send them a Certified rescission letter today. It probably won't work, but stranger things have happened, and if you don't try, you'll always wonder.

Nothing fancy needed. Something like:
I/We wish to exercise our right to rescind and cancel our timeshare purchase #________, dated 9/XX/2019 at (place).
Signed__________(Husband)___________(Wife)
send it USPS Certified w/return receipt to the business address, not the resort where you bought.

What state were you physically in when you bought. I'm not sure the credit documents are what the law is talking about but a look at the particular state law would help.

I brought this in FL. NOLO website says 10 calendar days after signing the contract or receiving all required documents. You made a good point about what is exactly "required documents" mean. I feel any charge and how is is collect is part of the contract. At least that how I understand at https://www.flsenate.gov/Laws/Statutes/2012/721.06.
