I was not aware that WestGate has the "right of first refusal" until I placed my ad to sell on TUG. I had a buyer and we started the process for him to buy it, contacted WestGate and the title company at which time I found out about their "right". In my case, they did exercise that right and they are taking back my 2 weeks, paying me my asking price and covering the closing costs. So if you are trying to sell your WestGate weeks you will have to go thru WestGate first to see if they will take it back vs letting you sell it.

Generally speaking, you can't go through the company FIRST...ROFR is something they exercise against an offer that has been made and accepted. So first, you have to have a deal that is ready to go through and then they either exercise their ROFR to get it themselves for that price or they waive ROFR and let the sale proceed.

Also, ROFR is only allowed if it was written into your original documents. So people who own Westgate properties purchased long ago may not be subjected to it. I believe others have discussed that it is in all the documents for the more recent sales; but Westgate has tried to use ROFR even when it didn't apply. As long as they match the offer and actually pay you then it seems okay to me. Before selling you could check with Westgate to see if it applies, but learnalot is correct in saying you need to have a buyer first before they would attempt to exercise ROFR.

WestGate Fake ROFR.

From what I have read right here on TUG-BBS, not all the WestGate timeshare deeds contain ROFR. Even so, the WestGate timeshare company has been known to bluff that it has ROFR even when it doesn't.

How to tell which WestGate deeds are which, I don't know.

Plus, I don't know how to call their bluff if they assert that they have ROFR on some particular deed on which they have no such thing.

Fortunately for me, I don't have any WestGate timeshares, ROFR or non-ROFR mox nix.

I have no use for Westgate whatsoever, but if they are paying you what you had already agreed to accept from a buyer in a private sale anyhow, and they are also paying the closing costs, then just take the money and run and be happy to be able to permanently part company with Westgate.

Then again, I'd recommend waiting to make sure that any check from Westgate actually "cleared" before I'd go and spend that money. :rolleyes:

@tlc hasn't been back since they made the initial post in this thread six years ago. I doubt they will see this and even if you PMed them, I doubt they would respond. If you can get Westgate to step in at any price, you are ahead of the game.

We had a week at Westgate given to us. We were told then that not to worry about any rofr as they purchased long before Westgate added it.

No issues getting it. 2 years later when we thought we gave it away, Westgate stated they had rofr and they were exercising that right.

We didn't care as we were getting rid of it anyway and didn't want to fight over whether they did it didn't have that right.

Since we were giving it away we didn't get any money from Westgate and we actually were charged a small fee for the release. Again, we didn't fight this as we were getting out. I can't remember the amount but it was around 100 bucks if I recall.
