Resale Market Closed....HGVC still have property listed under old owners

Hey Guys,

As the title suggests, I closed about 4 weeks ago on a resale through Judi K. I called HGVC to try to get info on my new account, but from what the rep said (after giving him the old owner's account number because that's all I had), the property is sitll listed under the old owners name, meaning, I can't get into the account. Has anyone ever encountered this? Any idea how to proceed? I emailed our agent Dana at Judi K's office Friday, but haven't heard back (it's a holiday weekend so I understand), but I am getting antsy since it's already October and I would like to not get shut out of any rooms in the beginning of 2018.

Closing and having a deed recorded are only parts of a complete transfer. It may take HGVC a couple weeks to complete the transfer on their end. Judi K and her team will hopefully provide you with some peace of mind on Monday.

The closing is only the beginning of the transfer process. The deed must be recorded and returned by the County, then the docs are sent to HGVC, and HGVC then reviews them before making the transfer on their books... and only after that do they start setting up a new account. I'd get antsy at 4 weeks, but would not get peeved until about 6 weeks. Check with the closing agent on where they're at in the process.

Thanks all. It's been exactly a month. Apparently the closing company had the description of the property incorrect on the recorded deed, so they have to go back and correct that. I assume it will take another few weeks now. Question for the panel, should I be pushing to get some kind of money back or some kind of recourse for their error? To be honest, it seems as though when you pay for a service you expect it do be done right. And also, no one told me any of this, I had to send a few emails and make a few phone calls on my end to get this information. And I know everyone sings Judi K's praises (and I know mistakes happen), but an email and a phone call to her broker went unanswered (it was the Closing Service that got back to me with this info after I contacted them).

For our first year, I actually am going to be looking to do an RCI exchange into New Orleans. My family has some credit with Amtrak and I think we are going to look to take the train down from NYC. Should be a nice ride.

Unless there was some sort of performance clause in your paperwork guaranteeing closing in a certain amount of time or that no errors would ever be made, I don't think you have a case for a refund.

Mistakes happen. Move on.

I doubt that you could show much in the way of $$ damages.
OTOH, I'd whine to Judi who's 'sposed to stay on top of things.

I have no problem with moving on - or not looking to make a big deal about it, but I don't agree with your logic behind it.

the professional closing company, whom I paid a fee for a service to (that is to transfer the property by recording the correct information with the appropriate county clerk) screwed up. Yes, mistakes happen, but something like this shouldn't, when your sole Job is to make sure the transfer goes smoothly. And the seller no doubt paid a fee to the broker to ensure that their sale went smoothly. Which it didn't. Also, if I didn't follow up, would anyone have let me know what's going on? I still haven't received any info from Re/max - just from the closing company (again in response to my inquiries).

Aa far as damages, they are minimal. I'm losing out on some enjoyment of the club (because of the nine month booking window already six months into 2018, maybe some open season offers and other club benefits, but probably nothing that could really be considered of any value , but that being said, I did pay a fee to the closing company for a service, which has not been up to par. If it was an airline that had a maintnance delay, you bet there would be poeple complaining, even though they still got from point a to point b safely.

Just my two cents. Again, not looking to make a big deal, but to brush it off as "mistakes happen," isn't, IMHO, ok.

Any real estate closing (refinance, purchase, etc.) I have done has included a statement that the parties agree to resolve any issue if a mistake (not fraud) was made in the paperwork. That is where my opinion came from in my last post, and I will stand by it. You are certainly welcome to your opinion to feel that you are owed a refund, but I just don't see it (you did ask for opinions...).
