At this point, all you can do is make your payments, and learn how to get the most out of your timeshare. You came to the right place for that.

Denise,
Thanks for your reply. I had my baby on the trip and he had an asthma crises there for that reason I could not think about anything else. I was in a strange country with a sick baby. I have all the doctors papers and stuff, wouldn't that help? Don't you think I should give it a try at least?
Thanks!

I for one think you should give it a try. There are several reports on these boards, and others, of folks that were let out of their contract after the rescission period.

And if you can't get out of it, join the rest of us who bought retail, shrug off the regret and enjoy the years of vacationing you will get out of your unit. Then buy the rest resale.

I am sorry to hear about your baby. I too have had children with asthma issues in Florida. I have my 33 year old with me on a trip to Disney right now and one of the trips down memory lane we took was to show her the quickcare clinic we used on multiple occasions!

Not sure what recourse defaulting on a contract in the US would have on your life in Brasil.

I am thinking not much

Watch out for those scammers out there who call you (or even post Google ads on timeshare websites) claiming that they can get you out of your timeshare agreement, sell/rent your timeshare for mega-bucks, or sue the timeshare salesperson/developer if you pay them some sort of hefty fee beforehand.

They're all attempting to take advantage of people like you who appear desperate and naive.

Unfortunate family matters notwithstanding, you really have no legal recourse for unilateral contract cancellation at this late date, unless there were legal or procedural errors at the time of contract execution. That's not likely --- Florida sales weasels have been at this game for a long time and are pretty slick.

That being said, you could still certainly ask (in writing, not by phone) to be released from the contract, perhaps even mentioning a willingness to voluntarily forfeit the deposit you paid at the time of purchase. The developer might very well realize that they really have little or no leverage over you if you are actually located in in Brazil and announce clearly that you will pay nothing further. They may accordingly be willing to just "release you", keep your deposit money and then sell the same "product" all over again to someone else instead. Personally, I don't see much risk, harm or downside (apart from forfeiting your deposit) to at least making the request...
