This is not for me it is for someone else; Ive never rescinded a contract before. She bought yesterday and wants to rescind. She has left the resort now and looked through her paperwork and doesnt have a contract. What should I tell her?
Which resort? What state? Sampler package or full blown timeshare? How much was the timeshare? She needs to get on TUG herself to answer our questions. We are not going on much information.
If she has SOMETHING that has her signature(s) and some sort of identifying number/letter code of anything, and the date signed, she should generate a rescission letter to the seller's business address staying clearly that she's exercising her right of rescission. If she left their sales room without some copies of paperwork she signed, shame on her.
I think she just got frustrated and wanted to get out of there. I referred her to this post. She bought rci points with a home resort in cape cod. i asked her to check to see if she had anything with signatures or a contract number. She might have to wait until tomorrow to call to get an email copy of her contract.
i hang out on some Facebook forums, this girl was on rci, I am so surprised how much incorrect information is given. I must refer people to tugs at least once a week. I've been timesharing for 20 years and I think I know about half. It makes me feel bad when people buy on emotion and are taken advantage or they get frustrated and give up. Yes, I know it's their fault...buyer beware. i know it doesn't make sense to pay thousands of dollars for something and not be sure of what you bought. But I still feel bad.
Have her (and anyone else that signed) write a signed letter stating she is rescinding the purchase made on x date at x location. Send to the address that she signed at and any address she can find at RCI. Send registered mail with proof of mailing. She could also email and fax to any contact info she has in her package.

It's not so much that it's emotion. It's just the unethical sales tactics that the sales people use. When unsuspecting buyers sign on the dotted line, it's usually because they are mentally worn down and will do anything just to get out of there including signing a multi-thousand dollar contract.
