Timeshare Owner Liability

As deeded owners how are we protected from liability due to a catastrophic incident where personal injury occurs or a "@metoo claim" claim of an employee of the HOA or management entity?

Similar to your homeowners policy with umbrella, the resorts should have umbrella liability insurance which basically will put the insurance company lawyers to fight and pay out a claim if warranted. We pay for employers insurance through our HOA.

A bigger risk is someone hurting themselves on the property and suing the HOA. This usually is covered by umbrella insurance.

Check with your HOA on coverage.

Also, you should always ask these questions of your Board of Directors, at the AGM and/or ad hoc .

I assume the HOA/Management has worker's compensation insurance to cover employees for on the job injuries.

never assume! demand facts from your HOA board and staff. analyse any insurance policies for sufficiency the same way you do for your own home.

while I'm on my soapbox, ask detailed financial questions as well. as a CPA, I've seen lots of trouble occur when people just trust others without asking questions

Maybe an owner could chime in. But a few years ago a intoxicated person dived into the water from Galleon property in KW. There was a successful suit by the now crippled diver. I heard there was a special assessment of several dollars pr week, but that could of been bar talk.
