If a married person buys a timeshare and has their name only on the ownership, does their husband / wife have any obligation to keep this when the person named in the ownership docs passes away ?

No, anyone can refuse inheritance if their name isn’t on the deed.

So if my name is the only name on the contract would that mean my wife has no obligation to this contract when I die ?

I’m not a lawyer, so don’t take this as legal advice, but my understanding of inheritance is you can refuse any inheritance you do not want.

Whomever manages the estate should send a letter after death informing the timeshare and letting them know the inheritance was refused.

I am not a lawyer either. However, my understanding is that in a community property state everything belongs to both parties unless an active process is used to maintain separate property.

So I called the resort and told them I was thinking of buying a timeshare but my wife isn't going to participate in any way other than vacations. I also asked if she would be stuck with this timeshare when I pass. Their reply was the only owner is the one that signs the contract and once that person passes then that owners estate would decide what to do with it. If some one wants it , fine, if not , fine as well.

So I'm thinking about my next buy to add to my collection.
