Need atty. for Hilton Head, SC

I never thought this would be difficult, but I am having a hard time finding an attorney to handle a closing for me in Hilton Head, SC. Can anyone provide me a recommendation? Time is becoming a factor. Thanks.

No need for an attorney, unless that's a personal preference. There are some very capable timeshare closing companies that cost much less than most attorneys. See the "Once You Have a Buyer" section of this link for names. Timeshare Closing Services, one of the companies linked in that section, does an okay job and handles SC timeshare closings for about $300.

There are many aspects of a closing that a closing company can handle very well, but one key question you need to ask is who prepares the deed? That is one part of the closing that I have very frequently seen these out of state closing companies screw up. Their deeds are often prepared by layman or out of state attorney and are all too often (at least in North Carolina) defective to the extent they do not pass good title. Indeed when they prepare such deeds in North Carolina, they may be violating at least two criminal laws when someone other than a North Carolina attorney charges for deed prep for a timeshare. If you go with a closing company, at least try to find one located in South Carolina. They are much more likely to get a South Carolina deed right!

I have also used Daniel P. Zwerner for several HHI closings. LeAnn O'Donnell, his paralegal handled everything for us. The legal fee for his closing services was $375. There was an additional charge of $50 if you took the title insurance. The phone number is; 843 686-3700.

At one time, and maybe still, Beaufort County had a deed form on their website. When I purchased a HHI timeshare, the SC atty handling the transaction prepared and recorded deeds with incorrect legal descriptions twice. I think they finally used the deed that I prepared with the correct legal. There is no assurance that using a SC atty will result in an errorless transaction.

I also recommend Daniel Zwerner and his legal assistant LeAnn, Wonderful to deal with and reasonably priced. Quickest transfer I have ever had, with the exeption of those done myself with a Quit Claim. I would recommend you at least call them and see if they can help you out.

$375 for a closing from a local attorney who knows what he is doing sure beats one from an out-of-state timeshare closing company that may not!

Actually in South Carolina, an attorney licensed to practice in SC is required to prepare the deed and disburse closing funds and record the documents. There is a lot of case law in South Carolina that not using a SC attorney to do that is the unauthorized practice of law and the are one of the few states that goes after the party that is collecting fees and not being a lawyer.
