Deed Registration & Timeshare Advocates

I am an owner of a float week at Edgewater Beach Resort in Dennis, MA. I was recently contacted by a Timeshare Advocates of Worcester. They told me that the developer failed to properly record my deed. They supplied the web site for Barnestable County and showed me that when my name is entered there is no match. Has anyone else been contacted? Is is possible that the deed really never did get recorded? Any information would be greatly appreciated. I do not know whether or not legal action should be taken at this time. Please advise.

First, STOP. Anyone contacting you about anything like this is after something.

Your first step should be to pull your copy of the deed. Is it recorded? Then contact the county and ask if you have a recorded deed why are you not showing up on their database? Then contact the resort?

BUT I'd be very afraid of Timeshare Advocates of Worcester, what is their association with this whole thing?

do you own a points type contract? Often, those are not recorded. I agree, stop, call your resort, ask them and then go from there. No one just calls you up saying the deed is not recorded....
 
Deed Registration

They are probably right about the deed. There are many timeshares at the Edgewater that were sold, but the deed / license was never recorded (mine is one of them) The people who sold these units are currently being sued by dozens of companies and owners that were bilked.
I got the same letter, but already was aware of the problem. I don't know who these people are, but I know several groups have been trying to scam owners. Check out the Edgewater HOA web site for more information. http://www.edgewaterresorthoa.org/

Edgewater Beach resort deed?

Thank you for your response. I did contact the resort who said that all I need is a Notice of Time Share License and NOT a DEED. Has anyone ever heard of this? Thank you.
 
Timeshare Advocates-Edgewater Beach Resort, MA

Hello, I too have a floating timeshare at Edgewater and received the letter from Timeshare Advocates. I called them and they said they have helped over 700 timeshare owners to get their deed recorded or to get the money refunded. I just spoke with Edgewater manager, and she stated the Timeshare Advocates was a scam and that they have not refunded any monies to timeshare owners to date. She said this letter is based on an employee that was let go and this person was able to leave with names and numbers of Edgewater owner and that is how the Timeshare Advocates were able to find out our addresses and numbers. She also stated that after 2002 new owners were to receive a license and not a deed. I was originally told it was a dead not a license. My understanding is a license eventually expires and then the timeshare goes back to the selling resort and a Deed is forever. Also, was told for a fee, $100 or $200, someone from Edgewater would be able to tell us how to record the license which is confusing since I already paid this when I bought the timeshare but was told the original people who sold me the timeshare has no money to record any license and they no longer are able to sell timeshares for Edgewater. Still Confussed!!!
 
License Vs Deed

I did send in my $26 to Carol Andreozzi at Inn Season Management Inc. at 212 Mid Tech Drive in W. Yarmouth MA. I was told this was all that was needed to start the process of obtaining the "Notice of Time Share License". I guess I have to wait and see what comes of this. I will keep you posted.

i just came back from that timeshare advocate meeting

just came back from that timeshare advocate meeting and it does seem scamy. They want $700 for filing paper to aquire a refund for you time share to the AG office. I am an owner at the Edge water and THE FACT OF THE MATTER IS!!! I have a week that I do not own, it is licenced into which i was sold. I was mislead and told is will be deeded for LIFE!! now yes, time share advocates again seemed scamy, BUT opened my eyes on the matter that I was taken for a ride..
FACTS: the owner of EdgeWater is in a big heep, if at any reason the place gets sold or bankrupted we all lost out!!!!!!!!!!!!!!!!!!!! i will see how to pursue this I do want a refund this is bull.

If you talk to the staff of edge water they are trained on how to tell you that your LICENSE is just as good as a deed, BUT when you bring up the legal issues of how it is not, the conversation comes to a halt and they want you to call a different number. I didnt call the secondary because I knew it was going to escalate things further.

Is highly llikely that many folks in this situation will have grounds for a lawsuit.
This is what "lawyers" are for. Many offer no or low fee initial consults.
 
There is no reason to pay someone $700. Make a call to the AG's office and see what they say about the situation. If there are really that many people (700) that they have helped there must be staff there that know what is going on.

If you have a deed or a lease either should be filed at the clerks office so get a copy of what you have.

Edgewater Beach Resort - deed vs. license

I too received a package from Timeshare Advocates to hear what they have to say but left a message. P.S. I think the outfit and website is shlocky. As an attorney I recognize that they probably cannot deliver what they are promising and they may have a vested interest in $ and undermining Edgewater (supposedly former partner of developer or NERM is owner of Timeshare Advocates). However, it was the first time it was brought to my attention that I may not own a deeded week but may only be entitled to a license to use my week. Also that whatever interest we may have was not recorded in the county land records so I do not have marketable title to whatever interest that may be.

Next step I called and spoke with the attorney for the Board of Edgewater to get the low down on the Timeshare Advocates package and then sent him an email after he promised to look into some of my questions.

I am an attorney who has a working knowlege of some of the issues that the average resort owner may not have. I asked the Board attorney to find out which form of ownership I am entitled to and if it is only a license vs. a deed the duration of the license, i.e., term of years, life use, in perpetuity and what the recourse is if it is less that what we bargained for.

I'll keep you posted.
 
Edgewater and Pollard Brrok

Edgewater and Pollard Brrok are both managed by InnSeasons. InnSeasons seems to be in trouble. I am trying to help my son transfer a unit at Pollard Brook to a family member. I transferred it to him 2 years ago without a hitch with a transfer fee of $75.00. Now they want $400.00 and refuse to explain what the $400.00 includes. They seem to have a take it or leave it attitude. I have tried to find out who the princilples of InnSeasons are but so far no success. I have a feeling they are the developers of Pollard Brook and Southern Peaks which is in dire financial straights. See link. Pollard Brook just charged SOME Pollard Brook owners with a $500.00 special assessment fee.
