We signed contract last Sunday. We changed our minds after calculating expenses over time. We sent rescinding letter last Tuesday. We sent it to the main resort in Escondido because it was the mailing address in the contract. Is that correct? We have 5 days to cancel according to the contract. We do have until Friday. Should we send another one to the Branson resort where we signed? The contract also didn't say to return the booklet. Should we send like some of the responses on this thread said? How long should we follow up on getting the deposit back to our credit card? Should we contact them? When should this happen?

We really appreciate this website. We wish we found this prior to our trip.

In your contract, there was a specific address to mail your recession letter to. That is the address to us.

How long should we follow up on getting the deposit back to our credit card? Should we contact them? When should this happen?

Assuming you mailed it certified mail, so you have proof - now you should do NOTHING.

That means do not call, and do not accept their calls - let the answering machine pick up. Phone calls have NO legal standing when you rescind, so there is no reason to talk to them, and if you do, you will just get more high pressure and lies, and they might talk you out of it.

It will probably take 30-45 days to get your refund. They don't have any choice - it's the LAW, not their option.

So now you need to just sit tight, and wait for the refund.

Contract Says

Notice: You have the right to cancel this agreement within five days after the date of this agreement. Cancellation must be in writing and if sent by mail, addressed to the other contracting party as shown on this agreement, cancellation will be accomplished at the moment the letter is postmarked. If sent by mail, the letter may be certified with a return receipt requested. Your right to cancel cannot be waived. This agreement is made pursuant to the laws of the state of Missouri. Should the terms of any docuemnts that accompany this agreement conflict with the terms of this agreement, the terms of this agreement will prevail. (Thumb typed)

The "seller" and the other party of the contract said Welk Resorts Group with the address in California.

I will scan the contract again and see if I missed anything. I guess I can send one to the Resort. Should the escrow holder get a letter too? Sorry. Just want to make sure I got it covered before deadline expires.

This says to send it to the address on the contract, so that is what you should do:
addressed to the other contracting party as shown on this agreement


Should the escrow holder get a letter too?
I'm guessing that you mean the "mortgage holder" - no - they cannot cancel your contract - only Welk can do that.

Here's an update. We tracked the mail. It got to Escondido last Thursday. You mentioned to do nothing and just wait for the refund in 30-45 days. What are our guarantees that our contract was cancelled when we only have a certified mail receipt? The monthly payment will start in August. What did some of you do while waiting? What did Welk do after the received the mail? Thank you.

Welk does not have a choice - the right to rescind is a state law - they must let you rescind.

Your guarantee is the State Law.

Remember - nothing you or they say over the phone has any legal standing, because you can only rescind in writing - talking to them can only muck it up - it cannot help.

What did Welk do after the received the mail?

They probably told your sales person to give you a call and talk you out of it - don't talk to them -PERIOD!

This is for anyone who's interested with our rescind timeline.

- signed contract (7/24)
- sent rescind letter (7/26)
- front desk received letter (7/28 c/o USPS tracking)
- customer service left voicemail (7/31)

We are not returning the call so we don't get pressured back into the mess we did. We are just relieved that someone is getting in touch with us because they received out letter. Whew!

Thanks again for the advises! We were worried it would be dead silent for the next coming weeks and we'd have to chase Welk to get our deposit back. We're still crossing our fingers that it will all be smooth sailing from here on out.
