AC -- Atlantic Palace Need Advice on Deed Problem

Need some help Tuggers....I am at a loss at what to tell my parents.

My parents bought a week from the Atlantic Palace in Atlantic City about 5 years ago from the developer......sales person told them they were buying Red Time, that they could use the resort during the summer or reserve a prime week to trade into RCI.

After several years of not being able to get into the Palace during the summer and not being able to get the trades they wanted in RCI, my mother finally asked the RCI rep why.....she was told that her trade week was a fall week and that it was a poor trader.

Mom and dad called Atlantic Palace and were told to come on down to the resort and they would help fix the problem.....they drive down only to get a two hour pitch on how they need to buy more time to get better trades.

Dad finally pulls out the deed when he gets home.....low and behold...THE DEED HAS NO WEEK NUMBER ASSIGNED TO THE UNIT. In fact, the only thing that even mentions a week or red time is the hand written credit card carbon my father has from where he prepaid his first maint. fees that says "Pre-Payment for Red Time Yearly Dues".

Dad has since called the Palace back and is now getting the big run around. He was told today that they would fax their copies of the papers to him today to cross check......fax never came. He called back 3 hours later and was told that the person on duty couldn't help him, that they would take a message for a manager....still no call back.

Has anyone else seen this type of either fraud or screwup? Recourse options?

It is highly likely that amongst the papers that your parents signed was a declaration that the agreement of sale constituted only what was stated in writing and did not include anything else that your parents may believed they were promised. Even if the deed specified that your interval was floating Red Time it would not help you much. The definition of Red Time varies; there is no industry wide standard for determining Red Time. Many Atlantic City timeshares consider weeks 13-47 and 51 & 52 to be Red Time. I recall that the Atlantic Palace's definition included even more of the winter months. Consequently, I would say you have no recourse unless you can find documentation that guarantees you a summer week.
