We want to give away a 2 bedroom timeshare unit at Westin's Mission Hills resort in Rancho Mirage, California.

The timeshare is for Week 17 in the platinum season and the 2015 maintenance fee is $1,767.27.

A friend tried to buy one through ebay but it was "snatched" during their ROFR process.

Because this is a giveaway, do you think that it would be exempt from the ROFR?
