Misleading Developer Sales Claims about Cypress Pointe

Rather than just complain to the developer, I would recommend that the HOA do he following:

1 Send a letter to all TS owners advising them of the problem.

2. Send a complaint to the Attorney General's office in Florida telling them what has occurred.

3. Send a complaint to the BBB so that the BBB can warn consumers.

4. Advise TS owners who believe that they were defrauded to file complaints with the Attorney General's office and the BBB.

More speficially, with respect to the State of Florida:

Board Meeting scheduled for 2pm Tuesday 8/26

There is a Board Meeting scheduled for 2pm Tuesday 8/26 with the sole adgenda item being Sales Practices.

I'll be interested in hearing what happens here. Is there anything the HOA can really do if the developer has a legal right to be onsite? Perhaps print and display flyers in each villa providing accurate info- but other than that- I wouldn't hold my breath.

I believe there is now a sign in the lobby at Cypress Pointe indicating that there is no SA planned. Depending on where the sign was placed, a person would more or less walk right by the sign to reach the sales office upstairs.

Additionally, the courteous folks at the front desk are only a few steps away from the sales office, making it easy to either obtain correct answers - or at least get pointed to a good source for correct answers - for things that don't quite make sense.

This SA ploy, (and the financial health of the resort), has also been communicated at CP's website and within the owners' online forum.

If anybody is duped by the nefarious SA untruth at this point, I'm going to struggle to generate much sympathy.

Board Meets and gets assurances

The Board meeting regarding sales practices at Cypress Pointe Resort / Grande Villas (the Board of CPR does not represent them but they share our Clubhouse/Sales areas) met as scheduled at 2PM today. The situation regarding possibly misleading statements from sales staff as reported to the Board by owners regarding a special assessment were addressed. The Developer representatives have assured the Associations that this was an unfortunate misunderstanding regarding the current SA at CPGV. We have seen evidence that they took appropriate steps to stop the problem and have reviewed sales records to identify any potential sales that may have been prompted by the incorrect information.

The Board is satisfied with the actions taken and that this was not a pattern of any type of deceptive statements to owners. Unless new reports of such activity are made this issue will be considered closed.

As an additional note we in fact placed a notice in the lobby regarding our upcoming 2010 unit renovation and the fact that no special assessment will be required to fund it. We know our owners are sensitive to that subject, as most would be, especially since we had to have one during our last renovation in 2004 due to prior years inadequate reserve funding and past history of poor collections. What we are not saying is that the current SA at CPGV is a sign of a problem or poor planning on that Associations part. Exactly as we did they have struggled with the same poor management performance and collections issues in the past. They have made the changes needed and now, as we did before them, need to get things back into top shape NOW not in 5 years. They realized that there simply wasn't time to wait and collect fees slowly for the work required as should have been done in the last 5-6 years. It is a positive for the owners that they have taken the proper steps to right the resort and going forward have the plans in place to avoid it occurring again. Those types of plans can work if carried through - CPR has the bottomline annual performance to prove it.

So both sets of owners who share the two Cypress Pointe resorts have much to look forward to. Both resorts are only getting better, have solid financial results, good management and very active owner controlled Boards that welcome interaction with owners/guests.

Hats off to the HOA-BOD for not taking this lying down, for promptly confronting the issue head on, for following up with the corporate officials responsible for the on-site timeshare sellers, & for getting to the bottom of this vexing issue.
