What kind of attorney do I need to see to close on a Timeshare?

I'm looking to give away my Timeshare and am looking at what kind of attorney I need to close on a Timeshare, recommendations, and any other pointers. I'm guessing the attorney will likely need to be in the same state as where the Timeshare is located.

You don't need an attorney at all, unless your timeshare is in South Carolina. There are numerous "closing companies" that will handle the entire transaction for you for about $200 (plus whatever transfer fee the resort itself might impose). A favorite closing entity among folks here is LT Transfers, located in Cleveland, GA (http://www.lttransfers.com). And no, the closing entity need not be in the same state as that in which the timeshare is located.

Finding a willing (and legitimate) recipient for your timeshare is your first and biggest obstacle; that part of the process is entirely your responsibility. The transfer procedure itself is relatively straightforward when left to those who handle details of such matters every day --- and for less money than you would have to pay any attorney. The closing entity will prepare and record a new deed once you find yourself a new, legitimate "grantee" and the closing entity will notify the resort of the ownership change later by providing a copy of the new recorded deed to the resort.

Before "advertising", you would be wise to conclusively determine whether your resort charges a "transfer fee". Your profile indicates a "Fairfield" ownership (precursor to Wyndham, afaik). Wyndham's transfer fee is $299 per deed. Whatever that transfer fee might be, you need to know its' amount and you will need to consider in advance who will be paying it (i.e., you or the new recipient) if you "give away" the timeshare. Wyndham is going to demand and collect their $299 from someone before they will actually process and complete the ownership transfer.

Please re-read the posts above. LT Transfers is used and recommended by many people here on TUG. I have used them several times (and did so once again in recent weeks to handle a timeshare transaction in which I was the seller). They are competent, experienced, honest and the least expensive option around. They are also very nice people.

Again, your first and biggest hurdle is finding a legitimate recipient as new "grantee"; no one else can or will accomplish that part of the process for you.

A few in S and VA, a single resort in NC, MD, PA, and UT, plus Jamaica and the Bahamas
There are some states and/or countries where LT can't prepare the deed but if you own in one of those places they will let you know.

When I "divested" two of my Weeks located in South Carolina I did it without an attorney. I worked it out with the Purchasers that I would prepare the deeds; record them with the County; and notify the Resorts. This worked well but in both cases as the Resorts were HOA Controlled Independents. Had they been Marriott, Hilton, Wyndham, etc. I would have probably used an attorney.

LT may be great, but they will not handle a sale in USVI.

That is correct, by law, it has to be handled by an attorney in the USVI.
