What happens [to your timeshares] when you die

No one is required to inherit a timeshare, or anything else if they don't want it.

So you should have that conversation with your kids now.

If they do want it - leave it to them in your will.

If they don't want it - get rid of it when you stop using it.

You should also inform them that if you pass away unexpectedly, and they don't want it, that all of your heirs should inform the estate attorney that they will be refusing the timeshare, and they wish to file documents with the court to refuse it.

You clearly imply and convey that you have investigated issue and you are providing sound facts of conveyance

On what basis and personal experience and training do you submit your advice

I always look for inpu you seem to testify to fact you are an expert

To me it was simple. I had six weeks. I asked my kids who wanted them and told them I would transfer any Week they wanted into their name immediately and would continue to pay the MFs as long as I was alive. The deal would be that either of us could use them. My Son wanted one Week. No one wanted the rest so I slowly got rid of them.

George, the first two times I read this, I thought you were saying you had six weeks....to live. :eek:

Then I re-read again and realized you had six weeks of timeshare ownership.

I am an attorney and do probate regularly. As I said, probate court is needed based strictly on the dollar amount of the property involved, and has nothing to do with whether you have a will or not. The probate judge can rule on who should get property if the will is ruled deficient in some form, or if some disinherited relative claims the decedent was not of sound mind at the time of the will's writing. But a will has nothing whatsoever to do with whether you need to go to probate court.

To limit this discussion to timeshares, suffice it to say that you need to have an exit plan for them. For me, I plan to retitle the good ones that have value jointly to my relatives so that they can take them over when I can no longer travel. The ones I don't want to burden anyone with I will leave in my name alone and they can disclaim them.
