We put a deposit down on a fixed unit/fixed week at DRI's The Point at Poipu. The listing said it was for week 6, but when we got the closing papers to sign, the documents said week 16. The real estate agent (who seems reasonable and trustworthy) said the usage was for week 6 even though the deed says it's week 16. They are working to produce paperwork to prove that, but meanwhile the sale is in limbo. Has anyone bought a timeshare week in Hawaii where the fixed week in the deed didn't match the usage week? Is there a document that can prove what the usage week really is?

I would think the resort would be able to verify which is the correct week.

Where did you find the listing?

My $0.02 worth...

I claim no knowledge of timeshare matters Hawaiian, but it nonetheless still seems quite clear to me that merely checking the preceding deeds for this ownership (not the new one, which might just have a one digit typo error) would very promptly and quite conclusively demonstrate and prove exactly what the correct week number is.

Timeshare Resales Hawaii in Koloa, Kauai had the listing. I knew they had been around a long time so I called them to find out what listings were available. Even if the resort says the usage is week 6 when the deed is week 16, I want some paperwork to show that it will still be week 6 after the sale.

End of Story

Here's the end to a long, unusual story.
2/15/11 - We made an offer of $12,500 for a fixed unit/fixed week at DRI's the Point at Poipu.
4/15/11 - After waiting for DRI to turn down their option to match our offer, we received the closing papers. The original listing said the use week was for week 6, but the deed said the use week was for week 16. We asked for documentation that the use week was really week 6.
8/1/11 - After the seller battled with DRI to provide proper documentation for the week 6 usage, DRI said that they couldn't change the deed, and instead, they would buy the week from the seller.

We were quite disappointed that we couldn't buy the fixed week, that is until the special assessment was made. Now I can't believe DRI bought it back!
