I grabbed the following timelines from this site. I noticed that it says that there are some resorts with no ROFR, and range from 10 days, 15 days, 20 days and 30 days for ROFR. However, I'm wondering if these are calendar days or business days. The link doesn't say.

I am pretty sure they are actual days and not business days. The number of days is confusing and in practice it might be meaningless since the transfer department requires an ROFR waiver in order to process the transfer. They generally respond fairly quick though. About a week for the 30 day resorts.

I'm going on 15 calendar days on a resale but the Title company is telling me it's 15 business days. I'm getting a little antsy. It's actually been 30 days since it was submitted but it really didn't go in until April 12. I was a little peeved that they lied to me the first time on the submission date.

Steven, I don't know the real answer, but have always thought it was 30 calendar days -- I'm sorry this has been such a pain but really believe you will pass ROFR and get those weeks.

Steven, I just looked at my March closing on a MOC unit via Syed and Old Republic Title.

His office quoted 15 business days ROFR by Marriott, but as best as I can tell from the emails it cleared within a week to 10 calendar days. Probably just depends on the queue at Marriott.

That said, Syed and the title company were fast throughout the process. Appx. five weeks from me getting docs, signing, and final closing after the wire transfer.

I looked at the provision in the Grande Vista condo declaration documents. It just specifies days. No mention of business or calendar. Given that it doesn't mention "business", it would be calendar days.

In the last 6 months I had 4 units submitted for ROFR, Marriott told me 15 business days. One was over a holiday and they took a bit longer. On average, 2 to 3 weeks. If your submit date was April 12th, then you have 1 week to go. Hang in there! :)

You have to look to State Law in which the Timeshare is located. Many time when a time limit is less than 7 days it is business days. While if it is 7 days or more it is calendar days. I am not giving any legal advise. If nothing specific in the laws dealing with timeshares look up the general statutes.

I am not sure it is based on state law. The provisions are spelled out in the condo declaration CC&R documents. Not every property has ROFR and as you can see from the list, different properties in the same state have different number of days. Perhaps you are referring to the number of days for rescission of the purchase of a timeshare? That absolutely is based on state law.

True, but it may be moot when it comes to ROFR, because I think that is all based on calendar days.

Owner Services does not handle ROFR or transfers. They are different departments in different locations and they are not open on weekends.

On a side note what happens if Marriott takes too long? They lose their right legally but I think you still need the waiver form.

I received my ROFR waiver today. We started on 4/18 and today is 5/4. That's a little over 2 weeks.

What is a no waiver fee?

I believe it means that there is no $95 fee for the ROFR.

I agree. Since the guidelines were drafted by Marriott, they would be construed against them and in favor of a buyer in questions like this (basic contract law). Since 30 business days is longer than 30 calendar days, absent a declaration of business days in the document the interpretation most likely upheld by a court of law would be it means calendar days.
